SC issues notices on former CJ, MPs
Jayantha de Silva
Former Chief Justice Shirani Bandaranayake and two other
parliamentarians have been issued with notices by the Supreme Court
yesterday which also granted special leave to appeal against the
quashing of the Parliamentary Select Committee (PSC) findings which
found the former CJ guilty of misconduct while in office.
This is sequel to an application filed by Attorney General Palitha
Fernando seeking to set aside the Court of Appeal judgment to quash the
PSC findings.
The Bench constituted of Justice Eva Wanasundera, Justice Salem
Marsook and Justice Sathya Hettige. The application cited the former CJ
and two parliamentarians Vijitha Herath and R. Sampanthan as
respondents.
The AG in the role of amicus curiae submitted that not only the AG
but but any litigant can come before the court. It is a bad precedent
the court over ruling the PSC findings.
