Enjoining order issued against UNP on dismissal of NLC member
Roshan THUSHARA and Jayantha DE SILVA
The Colombo District Court Judge M.Y.M. Izerdeen yesterday issued an
enjoining order preventing the UNP from dismissing the National Labour
Congress (NLC) member and Provincial Councillor of Nuwara Eliya
Ameerdeen Abdul Azis who contested the last Provincial Council (PC)
elections on the UNP ticket.
Attorney-at-Law Faiz Musthapa PC appearing for the plaintiff pleaded
to both nullify in law and invalidate the letter dated June 14 sent to
the plaintiff by UNP General Secretary Tissa Attanayaka.
The Attorney-at-Law submitted that the plaintiff would have to bear
an irreparable loss as copies of the letter had been already sent to
both the Elections Commissioner and the Nuwara Eliya District Returning
Officer.
Furthermore the plaintiff by virtue of being both a PC member and a
citizen by expressing his support to the ruling party of the PC did not
violate any party constitution.
Apart from that, the District Court yesterday issued an enjoining
order valid till August 29 preventing the United Sri Lanka Democratic
Front President S.Sathasivam from dismissing the PC Councillor Murugaiya
Yogeswaran of the United Sri Lanka Democratic Front. The plaintiff had
contested the last PC election from the UNP.
Attorney-at-Law Tharaka Nanayakkara instructed by Attorney-at-Law
Sajeewa Kaluarachi appeared for the plaintiff.
