Choksy's statement decrying the JVP criticism that the Colombo Stock Exchange is for the rich man only, Nihal Sri Ameresekere, Business and Management Consultant and public interest activist questioned, as to how Choksy could make such a statement in the teeth of Choksy having acted to thwart a minority shareholder action instituted by Ameresekere in the public interest concerning a fraud. Ameresekere said the Special Presidential Commission, which comprised the then Supreme Court Judge Priyantha Perera, present Supreme Court Judge Hector Yapa and then Appeal Court Judge late Ninian Jayasuriya, on Choksy's written submissions had determined thus: "We are of the unanimous view that in this respect he (Choksy) had stated untrue, erroneous and false facts, which necessarily has a tendency to mislead and deceive the public in general and the Members of the Commission."
