Court of Appeal rulings in favour of former CJ challenged

An application was yesterday filed by an Attorney at Law in the
Supreme Court requesting special leave to appeal against two recent
Court of Appeal rulings that quashed the decisions of the Parliamentary
Select Committee (PSC) which found former Chief Justice Shirani
Bandaranayake guilty of misconduct.
Attorney at Law Sumudu Kantha Hewage requested the Supreme Court to
set aside the Court of Appeal order pertaining to refusal to consider
him as an intervening petitioner against the Court of
Appeal decision pertaining to the issuance of a writ of certiorari
quashing the Parliamentary Select Committee ruling in respect of the
impeachment motion against the former CJ.
He also moved court to set aside the Court of Appeal decision not to
permit the intervening application filed by him praying for the setting
aside or reversing the Court of Appeal decision to issue a certiorari
writ to quash the findings of the Parliamentary Select Committee.
The petition states that by its decision the Court of Appeal erred
and the decision itself is a bad precedent. |
