Weliamuna appears for Wele Suda’s wife’s Fundamental Rights petition
Piliduwa Bogahawattage Gayani alias Sujie, wife of well-known
underworld gang leader Wele Suda was arrested by the CID at the
Bandaranaike International Airport recently. Attorney J C Weliamuna
appeared for her in a Fundamental Rights petition filed by her against
the Maligakanda magistrate’s refusal to issue documents pertaining to
her bail application.
The Supreme Court which considered the Fundamental Rights petition
filed by Piliduwa Bogahawattage Gayanai alias Sujie, wife of Wele Suda
stated that since documents submitted to court in a case instituted
against a person or institution become public documents, anyone
including parties to the case should have the legal right to obtain such
documents. This petition fielded by the lawyer who appeared for Gayani
alias Sujie at the Maligakanda magistrate's court was heard before a two
judge Bench including Chief Justice Shirani Bandaranayake and Justice
Nimal Gamini Amaratunga. When Gayanai alias Sujie was produced before
the Maligakanda magistrate's court, while she was under detention
orders, a lawyer who appeared for her requested that she be granted
bail.
The request for bail was rejected by the Maligakanda magistrate. The
lawyer through this petition stated that this has prevented his client
who had been arrested without showing cause, from getting justice and
fair play and he (lawyer) from performing his duties.
As such attorney Weliamuna requested court to order the Maligakanda
magistrate to release the relevant documents. The Supreme Court which
considered the request decided to call the petition on a later date.
