Swadeshi obtains injunction order
Swadeshi Industrial Works PLC, manufacturer of Khomba herbal beauty
soap obtained an enjoining order against the manufacture of “Khomba
soap” by Vendol Venivel Co. (Pvt) Ltd. & Godakanda Herbals (Pvt) Ltd.
from the Commercial High Courts, Colombo on August 2, 2012.

Plaintiff,Swadeshi had produced Khomba herbal soap, for seven decades
and sort redress against Vendol Venivel Co (Pvt) Ltd and Godakanda
Herbals (Pvt) Ltd for allegedly producing another soap brand with a
similar packing to Khomba.
After considering the initial complaint by Swadeshi Industries, the
Colombo Commercial High Court judge imposed an injunction order against
the accused reasoning that the product from the accused is similar to
the Khomba herbal soap manufactured by Swadeshi and to preclude using
the packing as well.
The Colombo Commercial High Court’s enjoining order thus prevents the
accused of producing, distributing and marketing Khomba soap under a
similar packing. |
