Anoma Fonseka yesterday filed a Fundamental Rights application in the
Supreme Court on behalf of her husband Sarath Fonseka against his arrest
and detention.
Two petitioners, Anoma Fonseka and Shamila Perera of the National
Democratic Front complained to the Court that the arrest and detention
of Fonseka is illegal and was in violation of his Fundamental Rights.
Two petitioners sought a Court declaration that his arrest and detention
was in violation of his rights and to immediately and unconditionally
release the petitioner or to ensure that he would be taken to the Courts
at all the hearing ensuring his safety.
The petitioners cited the Army Commander, the officer-in-charge of
the security of the Colombo city, the Head of the Military Police and
the Attorney General as respondents.
The petitioners stated that Fonseka was the Presidential candidate
contested at the recently concluded Presidential Election under the NDF
nomination and was illegally arrested on February 8 evening by the
Military Police and was detained in a naval camp. They stated that the
detention has prevented Fonseka from taking his regular medicine. |
