Defendants directed to file objections

Colombo High Court Judge Ms. P. R. Walgama directed the defendants in the Jafferjee Brothers case to file objections on January 11, 2010.

Plaintiffs Azra Yusuf Ibrahim Jafferjee, Muzaffer Yusuf Ibrahim Jafferjee and Muzaffer Yusu Ibrahim Jafferjee cited Gulzar Hussain Jafferjee, Zohra Taher Ibrahim Jaferjee, Anver Jafferjee and Mohamedally Ibrahim Jafferjee as defendants.

Earlier President's Counsel Romesh de Silva, senior counsel for plaintiffs, move court for an enjoining order ex-parte for the reason that the partnership has been going on for a long time. However, I reserve my right to ask for enjoining order at a later date.

Romesh de Silva, PC moved court to grant the shortest possible date as the notice returnable date and application for interim injunction be heard as early as possible.

The High Court Judge in her order stated that the Court heard counsel in support of the instant application.

Hence the Court is of the view that it is appropriate to issue notice of interim injunction as prayed for in the prayer (c) to the plaint. Summons too shall be issued returnable November 19, 2009.
