Enjoining orders against removal of PAFFREL Chairman

The Colombo Commercial High Court Judge Gamini Amarasekera has issued two Enjoining Orders against the PAFFREL (People's Action for Free and Fair Elections) and its Board of Directors preventing them from conducting its Annual General meeting which was scheduled for June 26, 2009.

The order prevents the Board from taking any steps to remove its Chairman Kingsly Rodrigo from its membership and from directorship and from chairmanship of PAFFREL.

PAFFREL Chairman Kingsly Rodrigo cited the PAFFREL and its Board of Directors as respondents.

Rodrigo stated in his plaint that the AGM scheduled for June 26, 2009 was null and void on the basis that the said notice did not give 21 days notice of the meeting as required by Articles of the Association of the PAFFREL.

Rodrigo also sought a restraining order in terms of Section 233 of the Companies Act restraining the Respondents from holding the AGM based on the said notice.
