Relatives of dead, missing can forward affidavits to courts for death certificates

by Sarath Malalasekera

In the case of any person found dead or missing following the Tsunami tidal waves on December 26, 2004, their close relatives could forward an affidavit giving all the particulars about relatives who had died or gone missing to the Registrar of the respective Magistrate Courts to obtain the death certificate.

A notice had been issued to all Magistrate Courts in the affected areas on the direction of Chief Justice Sarath N. Silva, PC.

A printed 'Affidavit' is available at all Magistrate Courts in the affected areas.

"Claimants should complete all the clauses in the 'Affidavit' giving all correct information and submit the affidavit to the Registrar of the Magistrate Court in the affected area," the Chief Justice added.

The Chief Justice had appointed a special team of Magistrates to hold Magisterial inquiries into the deaths following the Tsunami.

The Magistrate will issue a death certificate stating, 'death was due to accident - drowning'.

This Magisterial inquest report could be forwarded to the Registrar of the respective Magistrates Court and obtain the death certificate.

The Chief Justice recently visited the Southern Range with 30 Judicial Officers and conducted Magisterial inquiries into the deaths of several persons in the South.

The Chief Justice will also visit the North and East to direct the area Magistrates to issue death certificates to the dead persons' close relatives.
