by Sarath Malalasekera Colombo Chief Magistrate and Additional District Judge Ms. Sarojini Kusala Weerawardena ordered officials of the National Child Protection Authority (NCPA) to record a statement from Janaki Silva, former Secretary of UNP Provincial Councillor Duminda Silva, currently in remand for alleged rape of an underage girl, yesterday. The Judge directed the NCPA officials to complete the investigations into the matter and forward a report to court as early as possible. The Judge also said that the Court would consider the application for bail in respect of the suspect made by Defence Counsel Nalin Ladduwahetty on Friday, September 24. At the outset, Ladduwahetty submitted to court that the important revelation was the medical report which had stated the victim was not sexually abused on the day that victim's father made the complaint to the police against his client. The complaint was made in order to harass the suspect when he was elected to the Provincial Council. He was unable to participate in Provincial Council proceedings due to this case, Ladduwahetty said. Sub Inspector W. D.T. Wijesena, OIC, Special Investigation Unit of the NCPA filing a further report said that, Ms. Janaki Silva, a former secretary of the suspect had alleged to have threatened the victim while she was attending a Church ceremony in Colombo and also had removed several pictures of the victim. At this stage, the Judge told the Senior Defence Counsel to assist the investigators to complete their investigations. SP Sunil Sahabandu with SI W. D. T. Wijesena and SI Indrani Abeygunasekera of the NCPA appeared for the prosecution. President's Counsel Daya Perera with Nalin Ladduwahetty with U.L.G. Bandara, Jeevatha Jayathillake, Sudath Perera, Deshan Hewavitharana, Namal Perera, Miss U.M.P.M. Madumalee, Aruna Wickremasinghe and Mahee Wijeweera istructed by Sudath Perera Associates appeared for the suspect. Considering submissions made by NCPA authorities earlier the Judge directed the Police to provide maximum security for the victim as there had been several death threats to the girl and her family members. On the last hearing date, Inspector W.T.G. Wijesena of the NCPA Special Investigation Unit filed a report in connection with the complaint made by the 13 year old victim on August 6. |
