Torana files FR Case claiming Rs. 10 m as damages

Kapila Tissa Kumara Kotalawala the proprietor of Torana Video Movies (Pvt) Ltd, has filed a case before Supreme Court claiming Rs 10 million as damages for alleged infringement of his Fundamental Rights by the raid conducted on Torana Video Movies in Kollupitiya and taking him into custody.

The Petitioner K. T. K. Kotalawala cited Nuwan Wedasinghe the Officer In Charge of the Colombo Crimes Division, Senior Superintendent of Police Sarath Lugoda, Inspector General of Police and the Attorney General among 15 respondents.

The petition filed through Attorney-at -Law Kapila Dusantha Epitawala stated that the Torana Video Movies was in possession of extremely rare cassette not even available at the National Film Corporation and provides invaluable service to the educational institutions and to the general public.

The Petitioner further states that on August 20, 2004 his Head Office at Kollupitiya was raided by two Police parties on search warrants issued by the magistrate's Court of Fort and Hulftsdorp and carried out investigations to find whether he was in possession of video tapes obtained fraudulently.

However no such video tapes were found. The Petitioner further stated that the respondents who took part in the raid failed and neglected to observe the provisions relating to such searches as laid down in the Criminal Procedure Code.

The petitioner prays the Supreme Court to grant him leave to proceed in respect of the infringement of his Fundamental Rights and to declare that his Fundamental Rights have been infringed by this action.

Further, the Petitioner prays to order the Respondents from first to twelth to pay him Rs ten million as compensation in view of irreparable and irredeemable loss and damage caused to his reputation.
