CA issues Stay Order on Consumer Protection Authority by Indeewara Thilakarathne The Court of Appeal yesterday issued a Stay Order restraining further proceedings of an inquiry initiated by the Consumer Protection Authority against Sri Lanka Telecom on the recent fare hike. The Court of Appeal also issued notice on the respondents returnable on September 14, 2004. The case came up for hearing before Justice S. Sri Skandarajah. Sri Lanka Telecom filed this writ application in the Court of Appeal seeking a writ of prohibition against the proceedings of an inquiry initiated by the Consumer Protection Authority against the recent fare hike by the Telecom. In this application, petitioner Sri Lanka Telecom has cited G. D. Kulathilaka, U. L. M. Mohideen, P. Baskaralingam, Consumer Protection Authority, Telecommunication Regulation Commission and C. Gamaethige as respondents. The petitioner states that the 4th respondent had lodged a complaint with the Consumer Protection Authority against the recent fare hike by the petitioner and that subsequently an inquiry was started. Therefore the petitioner prayed that a writ of Certiorari be issued quashing the determination of the 1st and the 2nd respondent dated August 12, 2004 to entertain and determine the complaint of the 4th respondent. The petitioner also prayed that a Stay Order be issued staying the proceedings of the inquiry initiated by the Consumer Protection Authority. H. L. de Silva PC with Nigel Hatch PC and D.
