Application for bail refused by Sarath Malalasekera Colombo Additional Magistrate Amalee Ranaweera yesterday refused an application for bail in respect of Kotte Municipal Councillor Anton Perera Jayasuriya remanded in connection with the alleged galvanized iron roofing sheets fraud and further remanded till June 22. The Magistrate directed Sub-Inspector R.M.A. Rajapaksa of the Colombo Crime Division (CCD) to submit a further report in connection with the other three suspects who had made confessions before the Magistrate earlier. The three suspects are M.A. Mohamed Rizan of Grandpass, Mohamed Shiraz of Colombo 12 and Susantha Kumara of Colombo 14. All four suspects were also further remanded till June 22. SI Rajapaksa quoting the Criminal Procedure Code Section 127 said if the three suspects had made voluntary confessions in order to assist the investigations in the future, they would be made State witnesses. Ajith Pathirana, senior counsel for second and third suspects submitted to court that his clients made confessions and will assist the investigators and to make them State witnesses. Earlier, Nalinda Indatissa, Senior Counsel for Jayasuriya moving for bail, submitted that some sheets recovered from a Moratuwa store were not the sheets imported from India. The Senior Counsel submitting a medical certificate from Dr. G.P.S. Fernando said his client's wife was suffering from an acute mental condition and this was aggravated after the suspect was taken into custody. Due to Jayasuriyas's wife's mental condition, their infant was suffering without proper attention. An uncle of the suspect was looking after the baby. Citing several authorities, Senior Counsel Indatissa said that there was no evidence to connect his client that he purchased 2,700 galvanized iron roofing sheets imported from India. Senior Counsel Indatissa with Dilrukshi Fernando and A.B.C. Mendis appeared for the Municipal Councillor. Ajith Pathirana with Suraj Kongalage and Dharmapriya appeared for the second and third suspects while Priyankara Walawe appeared for the fourth suspect. |
