Registrar of companies rejects application

The Registrar of Companies D. K. Hettiarachchi has rejected an application by Dr. Fazli Nizar of 67/5 Ward Place, Colombo 7 to incorporate "the Sri Lanka Pakistan Friendship Association" on the ground that he is satisfied that there is an active Association by that name existing for over 40 years.

This was sequel to objections made Ifthikar Aziz and M. C. Muneer President and Secretary of the Sri Lanka-Pakistan Friendship Association respectively to a draft Memorandum and Articles of Association submitted by K. A. S. Perera to incorporate an Association called Sri Lankan Pakistan Friendship Association. .

In terms of submissions made by both parties, a Sri Lanka-Pakistan Friendship Association had been in existence for 40 years and at its 39th Annual General Meeting some members of the main Association had broken away and formed the"Association" following a dispute that arose on audited accounts.

According to the final order of the Registrar the written submissions of the objector dated 5th September 2002 and the attached documents showed that the objectors had the blessings of the Pakistan High Commission and also the recognition by the Head of State in Sri Lanka.

"I am satisfied that an active existing association by the same name applied for and it is not prudent to exercise the Registrar's discretion to issue a license to dispense with the word 'Limited in this case'.

It was pointed out that normal friendship Associations within two countries are constituted with the blessings of the respective High Commission or Embassy and the Government of the particular country- in this instance the Pakistan High Commission in Sri Lanka and the Sri Lanka Government.
