Notices to be issued

Court of Appeal Judge Sri Skandaraja yesterday ordered notices to be
issued to respondents returnable on November 1st in the case where
Saruwa Liyanage Sunil, the chairman of the Akuressa Pradehiya Sabha has
filed action against his dismissal from the post he held. The
respondents cited are Mahinda Deshapriya, Commissioner of Elections,
Sunil Lochana Returning Officer of Akuressa and the Attorney General.
The Attorney at Law appearing for the petitioner submitted that in
Sri Lanka a member of a political party who had lost at an election
could cross over to the opposing side, become a minister and enjoy all
the privileges and perks while still remaining in the original political
party he/she belonged to, he asserted.
Judge ; I agree with your assertion. Janak Silva DSG; The petition is
seeking a certoriari writ to quash the relevant gazette notification.
The DSG informed that the legislator had been given 21 days to obtain
relief from court.
