Bail application on behalf of Fonseka

A bail application was filed in the Supreme Court yesterday on behalf of Gardiheva Sarath Chandralal Fonseka who is presently serving a three year sentence in the Welikada Prison upon being found guilty by the High Court in the White Flag Trial at Bar in November last year.

The bail application has listed Attorney General as the defendant appellant.

The seven sets of the bail application together with an affidavit is supported by Attorney at Law Nalin Laduwahetty .

The bail application states as follows ;

That the plaintiff appellant Fonseka sustained serious injuries in the abortive LTTE female suicide bombers attempt on his life. There is less probability of the plaintiff appellant absconding the High Court Judgment.

There are weakness in the judgment.

The bail application pleads the plaintiff appellant be enlarged on a suitable surety and prays for the payment of legal charges incurred in the action in addition to whatever relief the court deems suitable.

Earlier the plaintiff appellant Fonseka was sentenced to a term of three years imprisonment in addition to a Rs. 50,000 fine. In the event of non payment an additional term of six months imprisonment. The judgment was by a majority decision of the High Court Trial at Bar.
