Interim injunction issued

Commercial High Court Judge Mahinda Samayawardhana issued an interim injunction preventing the defendant, its servants, agents and all those acting under or through it, from using any packaging, trade dress and get-up identical or confusingly similar to the plaintiff’s packaging trade dress.

Fonterra Brands Lanka (Private) Limited, formerly known as New Zealand Milk Lanka Limited of Delgoda Road, Biyagama cited Maliban Milk Products (Private) Limited, 389, Galle Road, Ratmalana as defendant.

President’s Counsel Romesh de Silva with Attorneys Sugath Caldera and Manju Bandara instructed by Sudath Perera Associates supported the application on behalf of the Plaintiff.

The Court issued notice retunable on February 23.
