Chief incumbent to be indicted

The Attorney General yesterday informed the Supreme Court that
Maradana Bodhirajaramaya Chief Incumbent Uvathenna Sumana Thera and four
others will be indicted on possession of explosives fire arms, which
were taken into the custody on January 23.
When the fundamental rights application was forwarded by the
Petitioner Sumana Thera before the Supreme Court for illegal detention
and arrest was also rejected by the Supreme Court.
The Court also refused an application to grant bail to the
petitioner.
The court noted that whether or not the petitioner was in possession
of the offensive weapons could be determined only after a trial. Senior
State Counsel Riaz Hamza who appeared for the Attorney General will
inform the Court on September 3 whether indictments have been serve or
not, in order to begin the trial.
Petitioner Uvathenna Sumana Thera cited OIC CID Chandana de Silva,
the Director CID, Dematagoda STF camp Commanding Officer D.M.U.
Kodithuwakku, the Defence Secretary and the AG as respondents.
The Bench comprised Chief Justice Asoka de Silva, Justice Nimal
Gamini Amaratunga and Justice Ms. K Sripavan.
J.C. Weliamuna appeared for the petitioner. SSC Riyaz Hamza appeared
for the respondents. The application will be mentioned on September 3.
