Fonseka's vote issue: Case on July 13

The Court of Appeal yesterday fixed for support for July 13, with
notice to the respondents, an application seeking to unseat DNA
Parliamentarian General Sarath Fonseka on the basis that he was not a
registered voter. The Bench comprised Justice Sathya Hettige PC and
Justice Anil Gooneratne PC.
In this application, petitioner Ananda Mohandas of Ratmale Upper
Division, Haputale cited the Elections Commissioner, General Fonseka,
DNA General Secretary Vijitha Herath and the Attorney General as
respondents.
The petitioner in his application stated that the third respondent,
the DNA General Secretary knowingly that the second respondent was not a
registered voter, had included his name in the DNA nomination list for
the general election on April 8.
He stated that the first respondent, Elections Commissioner declared
him elected as a Parliamentarian in violation of the Elections Act. The
petitioner stated that a candidate should be a registered voter to be
eligible to contest in the General Election.
He submitted that the declaration that the second respondent duly
elected as a Parliamentarian was in violation of the Parliamentary
Elections Act and sought to quash the same.
Counsel C. Sooriyaarachchi appeared for the petitioner. The case was
fixed for support for July 13.
