Sarath Fonseka SC application put off for support
The Supreme Court yesterday put off for support the special leave
application challenging the Court of Appeal order refusing an
application for an interim order staying the proceedings of the Court
Martial against General Sarath Fonseka for June 17.
The Bench comprised Acting Chief Justice Dr Ms Shirani Bandaranayake,
Justice P.A. Ratnayake PC and Justice S.I. Imam.
President's Counsel Romesh de Silva for the petitioner made an
application seeking for time to support the application since he could
not obtain a copy of the order of the Court of Appeal.
Accordingly, the Court fixed the application for support for June 17.
In his application General Sarath Fonseka challenged order of the
Court of Appeal dated May 21, that refused an application seeking to
extend an interim order which stayed the proceedings of the Court
Martial against him.
The petitioner stated that the Court of Appeal order dated May 21
that refused an application by him seeking to extend the interim order
dated May 3, staying the first Court Martial was bad in law. He sought
to set aside the same.
The petitioner also sought to extend interim order until the final
determination of the application.
The application would be supported on June 17. |
