Malaka’s bail application refused

MOUNT LAVINIA: The Mount Lavinia Additional Magistrate Miss
Dharshika Wimalasiri yesterday refused an application for bail in
respect of Malaka Manoj Silva, the suspect in the assault on Accountant
Chaminda Senasinghe, and remanded till October 3.
On the last occasion the Magistrate refusing the application for bail
observed that according to the first Police report before Court, a
firearm had been used in the incident.
The Court also unable to reject the statement made by the victim
Chaminda Senasinghe, the Magistrate said. The suspect Malaka Silva was
yesterday present in Court when the case was called.
Earlier, President’s Counsel Denzil Gunaratne, senior counsel for the
suspect, moving for bail said that according to the statements recorded
by the police from several persons including the foreign woman, who was
at the scene at the time of the incident, the suspect had not used any
firearms during the incident and not assaulted any persons at the night
club.
The suspect also had received several injuries during the incident
and had complained to the Bambalapitiya Police.
On an application by the Bambalapitiya Police the Magistrate
yesterday issued notice on the Officer In-charge of the Bambalapitiya
police to appear in Court on the next date.
The Magistrate issued notice on the OIC Bambalapitiya following an
application by the Bambalapitiya Police in connection with the complaint
made by Malaka Manoj Silva against Chaminda Senasinghe that, Chaminda
had assaulted him (Malaka) at the night club on September 9 causing
several injuries to him.
President’s Counsel Denzil Gunaratne with Clinton Dabare, Buddhika
Jayasinghe, Ratna Gamage, Lloyd Galhena, Sumudu Hewage and Ruwan Perera
appeared for suspect Malaka Silva.

The Magistrate directed the case to be called again on October 3. |
