Colombo Chief Magistrate reserves order for March 24 by Sarath Malalasekera Colombo Chief Magistrate and Additional District Judge Sarojini Kusala Weerawardena yesterday reserved the order in respect of the submissions made by the Counsel for both parties in the Thilanga Sumathipala case, whether to re call prosecution witness Attorney-at-law Ms. Bandupriya Peiris to give evidence regarding the deed which she handed over to the CID for investigation or not. At the outset, Senior State Counsel Yasantha Kodagoda moved court to re call prosecution witness Ms. Bandupriya Peiris to establish that she had handed over the deed in question to the CID for further investigations. President's Counsel Gamini Marapana, Senior Counsel for Sumathipala, vehemently objected to the application to re call the prosecution witness Ms. Bandupriya Peiris to give evidence again in connection with the deed forwarded to the CID. Judge Weerawardena:- Adressing the Senior defence counsel, Is there an injustice if the prosecution witness recalled? Senior Defence Counsel:- One copy of the deed was handed over to the court and one to the CID. I do not know why the prosecution wanted to re call that witness. Senior State Counsel:- I would not take more than five minutes with the witness Ms. Bandupriya Peiris. After submissions by the Counsel the Judge reserved the order for March 24. Deputy Solicitor General Vijit Malalgoda with Senior State Counsel Yasantha Kodagoda, State Counsel Seneviratne and State Counsel Damith Totawatta appeared for the prosecution. President's Counsel Gamini Marapana with Dr. Harsha Cabral, Navin Marapana, Ranjan Srikantha, Wasantha Batagoda instructed by Priyantha Upali Amerasinghe appeared for the defence. |
