by Sandasen Marasinghe The case against former Air Force Commander Air Marshal Jayalath Weerakkody was taken up for hearing yesterday before Colombo High Court Judge Eric Basnayake. Weerakkody was indicted on two counts including committing culpable homicide not amounting to murder of Karunamuni Ratne Silva due to negligent driving of his WPGL 1233 car at Borella on June 15, 2002. Examined by the State Counsel Shanil Kularatne, Motor Vehicle Examiner Prabath Upul Kumara Wattegama said that he examined the car in question and also the lorry no. 43-5731 at Borella Police on June 15, 2002. Witness said that the front tyre of right side of the car had burst. Its headlights were broken and the engine of the car had been pushed back a bit. The tyres of the lorry were in good condition. He produced reports on these vehicles before the Court. Cross-examined by the Defence Counsel Anuja Premaratne witness said that the car had an anti locking break system (ABS) by which the dragging of the tyres on the road is prevented. The tyre marks are printed on road when the tyres were locked. Examiner of Motor Vehicles re-examined by Counsel Kularatne, said that the tyres of the car were not locked and the reaction time of driver can be lengthened under the influence of liquor. State Counsel Shanil Kularatbne appeared for Attorney General while Presidents Counsel Daya Perera , Anuja Premaratne and H. C. Ranawaka appeared for the Defence. |
