Case against former military spokesman : 

Prosecution permitted to add Indian forensic science expert to witness list

Colombo High Court Judge Rohini Perera yesterday permitted the prosecution to add Forensic Science expert and Examiner of Question Documents Professor Chandra Sekharan from India to the list of the witnesses when the case against former Military Spokesman Colonel Sumedha Perera and Former Bar Association of Sri Lanka Secretary Bandula Wijesinghe was taken for up for hearing.

The Court permitted Professor Chandra Sekharan, director of School of Sciences and Forensic science, National Law University of Jodhpur in India to be included in the list of witnesses when the prosecution pleaded permission to do so.

The indictment against the former BASL Secretary was in relation to the alleged certification of a fraudulent deed of gift and Colonel Sumedha Perera and H. M. Sarath Wijewardena for aiding and abetting in the commission of the deed. Bandula Wijesinghe, H. M. Sarath Wijewardana and A. K. Sumedha Perera were indicted on four counts.

Ashoka Obeysekara, an Attorney practising in the United Kingdom giving evidence stated that he was the son of the elder brother of the owner, Fredrick Wimaladarma Obeysekara, of the disputed land and 'Obesekara Walawwa' at Rajagiriya. His uncle was suffering from Parkinsons disease for nearly 15 years and was aware of it in 1986. In 1999 it was revealed that he was a victim of cancer. Sarath Wijewardana was his caretaker and he was given a plot of land. Fredrick Obeysekera died on July 2, 2001.

Witness further said that he was told by his uncle that the land will be given to him (witness). He (uncle) had told this to Sarath Wijewardana as well. But when he went to the land on July 13, 2001 he was threatened by a group of people who came in a van. Sarath Wijewardana told him that the land was given to him.

When witness inquired of the deed Sarath told him they were with Bandula Wijesinghe. The copies of the documents were written in Sinhala. According to these documents the land had been bequeathed to Colonel Sumedha Perera and Sarath Wijewardana by witness's uncle. Colonel Sumeda Perera was not a relative or even a friend of the family but he had been seen once at the 'Walawwa'.

According to the charges the first accused Bandula Wijesinghe had certified a forged deed of gift on June 11, 2001 which had been signed by an individual as Fredrick Wimaladarma Obeysekara to indicate that the property at No 137, Rajagiriya was released as a gift. The second and third accused had aided and abetted in the action. Senior State Counsel S. Thurairajah appeared for the Attorney General.

Presidents Counsel M. L. Ameen and Anil Silva appeared for the first accused, Anuja Premaratne and Rohan Senaratne appeared for the second and third accused while President's Counsel Desmond Fernando appeared for the aggrieved party.
