Bail application fixed for Sept. 30

The bail application filed before the Colombo High Court in respect of UNP Parlimantarian Abdul Cader in remand custody on an alleged charge of misappropriation of State funds was fixed for September 30 by Colombo High Court Judge Eric Basnayake yesterday.

Cader's son-in-law, Abdul Hameed Mohamed Fahumy filed the petition citing Officer in Charge of the Corruption Investigation Unit of Crime Devision, Police Headquarters and the Attorney-General.

The petitioner stated that Cader was taken into custody by the Police Special Investigation Unit on August 10, 2004 on an allegation that Cader forwarded a letter to former Samurdhi Minister S. B. Dissanayake requesting payment from the Samurdhi Social Development Trust Fund of rupees one million to provide 690 bags of samba rice to distribute at mosques and a cheque had been forwarded to Mahajana Stores, Gampola but the mosques received less rice while certain mosques did not receive any and thereby misappropriated State funds.

The petitioner stated that the Colombo Chief Magistrate remanded the suspect and refused to grant him bail.

The petition states that Cader who is a Member of Parliament possessed vast amount of wealth when he entered politics including a tea estate of 325 acres in Maskeliya with a tea factory.

He has provided financial and other assistance not only to mosques but to temples and Kovils as well in addition to destitute families in Kandy and Ratnapura districts.

The petitioner stated that the suspect consequent to the damage caused by the bomb at the Temple of Sacred Tooth Relic in 1998 offered Rs. 1,300,000 including 500,000 from his own funds.

Further the petition stated that suspect was a victim of diabetes, and kidney problems as well.

The petition prayed to issue notice on the respondents, to call for and examine the case record in Colombo Magistrate's Court, to set aside the order refusing bail made by the Magistrate and to enlarge the suspect on bail on any condition.

The Court which issued notice on the respondents fixed the trial for September 30.
