Court orders arrest of Duminda Silva

Colombo Chief Magistrate and Additional District Judge Ms. Sarojini Kusala Weerawardana yesterday directed the Police to arrest UNP Provincial Council Member Duminda Silva and produce him before court.

On an application by the National Child Protection Authority (NCPA), the Judge directed the Immigration and Emigration Controller not to allow Silva, who is wanted in connection with the alleged rape of an underage girl to leave the country and to inform the authorities at the Bandaranaike International Airport about the court order.

Considering the submissions made by the NCPA, the Judge directed Police to provide maximum security for the victim as there had been several death threats to the girl and her family members. The Judge also ordered the child to be handed over to her mother.

Inspector W.T.D. Wijesena of the NCPA Special Investigation Unit filing a report in connection with the complaint made by the 13-year- old victim on August 6 said Silva had allegedly raped her on several occasions.

The girl came to the special unit of the NCPA with her mother. In her complaint, the girl stated that she was born on July 28, 1988 and that this incident occurred recently. Silva had an affair with the eldest sister of the victim since 2002 and the suspect was a frequent visitor to the victim's house.

The NCPA officials told court that the suspect had obstructed when the victim was to be produced before a judicial medical officer by her parents. On August 9, NCPA officials produced the victim before the Colombo South Judicial Medical Officer and obtained a report.

The NCPA report before court stated that a complaint had been made earlier to the Athurugiriya Police Station and to the NCPA in connection with an attempt to kidnap the elder sister of the victim by the suspect and he had obtained an anticipatory bail from the Kaduwela Magistrate Court.

Bambalapitiya Police investigating a complaint of kidnapping of the father of the victim was looking for Silva to record a statement in connection with the complaint.

Police Investigations are directed by Colombo DIG Sirisena Herath and conducted by Chief Inspector Ananda Kumarasiri, OIC, Bambalapitiya Police.
