Court of Appeal reserves judgement in Chef-de-Mission appointment case by Wasantha Ramanayake The Court of Appeal yesterday reserved judgement for July 29, in the Writ application seeking to quash the appointment of the Chef-de-Mission (overall in charge) to the Sri Lankan Contingent for Olympic Games to be held in Athens, next month. The Bench comprised Justices Saleem Marsoof PC and S. Sriskandarajah. The court granted parties time till Friday to file written submissions. Four petitioners D.U.M. Jayathilaka of National Weightlifting Association, National Amateur Aquatic Sports Union (NAASU) Secretary Rifdy Fahmy, Committee Member of the Sri Lanka Wrestling Federation Captain Ranjith Mendis and former President of NAASU Vijitha Fernando cited 32 respondents including Sports Minister Jeevan Kumaranatunga, Secretary to the Ministry S. Ranugge and President of the National Olympic Committee Hemasiri Fernando. The petitioners stated that the Chef-de-Mission would hold the overall responsibility of the contingent participating in the Olympic Games and also would carry the national flag at the opening ceremony. They stated that the third respondent President of the NOC Hemasiri Fernando has unlawfully appointed Joseph Kenny as the Chef-de-Mission to the Sri Lankan Contingent. Petitioners sought to quash the appointment and to issue a Writ of Mandamus compelling the respondents to appoint a suitable person as Chef-de-Mission to the Sri Lankan Contingent. Sanjeeva Jayawardene with Shantha Sirimanne instructed by Sudath Perera Associates appeared for the petitioners. Senior State Counsel Ms. Murudhu Fernando appeared for the first and the second respondents, the Minister and the Secretary to the Ministry. M.A. Sumanthiran instructed by G.G. Arulpragasam appeared for Joseph Kenny. Harsha Amarasekera appeared for the NOC and its respondent officials. The judgement was reserved for Thursday (29). |
