No warrant required to arrest Ravi - Magistrate

Colombo Fort Magistrate and Additional District Judge Sarath C. Karunaratne yesterday observed that there was no need for a court warrant to arrest a suspect and that investigators could arrest a suspect and produce him in court if there was sufficient evidence for an arrest.

The judge made this observation while considering an anticipatory bail application filed by former Minister and UNP Colombo District MP Ravi Karunanayake following police investigations into a complaint of alleged criminal misappropriation against Karunanayake of CWE funds amounting to Rs.1,56,75000 while he was a Minister in the previous UNP regime.

The judge reserved his order for today, June 25, in respect of the anticipatory bail application filed by the MP. Earlier, the Judge directed the Controller of Immigration and Emigration not to allow Karunanayake and three others to leave the country without prior permission of the court.

The Judge refused an application by the Colombo Crimes and Corruption Investigation Unit to issue a warrant for the arrest and produce Karunanayake in court.

Refusing to issue warrant against Karunanayake, the Judge observed that the investigators could arrest a suspect and produced in court if there is sufficient evidence against him.

Inspector Ruwan Gunasekera, OIC, Colombo Crimes and Corruption Investigation Unit, filing a further report in connection with their investigations into the alleged criminal misappropriation of Rs.1,56,75000 funds of the CWE on a fraudulent lease transaction, moved court to issue a warrant for the arrest of Karunanayake.

President's Counsel Daya Perera, Senior Counsel for Karunanayake, said that the sports section of the Police Department was conducting investigations to arrest the suspect. Kalinga Indatissa, moving for anticipatory bail, submitted to court that the police had attempted to arrest his client stating that the court had issued a warrant against the his client.

Lakshman Ranasinghe, Shiraz Noordeen, Janaprith Fernando and a team of lawyers appeared for Karunanayake.
