by Indeewara Thilakarathne The Court of Appeal yesterday refixed hearing of the bail application filed by the Chairman Sri Lanka Telecom Thilanga Sumathipala for May 6. The Bench comprised Justices Nimal Ameratunga and Gamini A.L. Abeyratne. When the case came up for hearing yesterday, Senior State Counsel Yasantha Kodagoda made an application that the hearing be refixed as the Solicitor General Suhada Gamlath has been appointed the Secretary to the Ministry of Justice on April 30. The Counsel for the petitioner D.S. Wijesinghe PC objected to the application citing that the appointment of the Solicitor General Gamlath was made two weeks ago and that the Senior Counsel for the prosecution are competent enough to deal with the matter. Justice Amaratunga observed that there is a fundamental matter of law whether the Court has the jurisdiction to hear this bail application. In this application, the petitioner, Chairman Sri Lanka Telecom and former President Sri Lanka Cricket Thilanga Sumathipala has cited IGP, the Director Criminal Investigation Department, OIC Anti-Human Smuggling Unit and the Attorney General as respondents. Sumathipala is the second accused in the Magistrate's Court case where he is being charged for aiding and abetting Dhammika Amarasinghe to forge a passport in the name of Buddhika Priyashantha Godage and aiding and abetting Dhammika Amarasinghe to travel abroad using the forged passport. |
