Wayamba Provincial Council poll on schedule

by Wasantha Ramanayake

The Court of Appeal (CA) yesterday refused to grant an interim relief that sought to suspend the North-Western Provincial Council Election scheduled for April 24 until the final determination of a writ application.

Petitioner H.B. Abeyratne, UNF group leader for the electoral district of Kurunegala filed the writ of Certiorari application seeking to quash the nomination list of the United People's Freedom Alliance list for the North-Western Provincial on the grounds that it was not duly submitted with a copy of the nomination paper.

The Bench comprised Justices Andrew Somawansa and S.I. Imam. Wijedasa Rajapakse, PC, appearing for the North Western Chief Minister Athula Wijesinghe objected to this application.

It was pointed out that no interim order could be made as the postal voting had already commenced at 8 am yesterday.

The petitioner cited the Elections Commissioner, Returning Officer Kurunegala, Freedom Alliance General Secretary Susil Premjayantha, the UPFA candidates and the Attorney General as respondents.

The court refusing the interim relief granted time to file objections on or before May 12.

Kalinga Indatissa appeared for the petitioner.

Dr. Jayampathi Wickremarathne PC with Gaston Jayakody also appeared for the respondents. State Counsel Janak de Silva appeared for the Attorney General.
