BOI refutes ICFTU allegations of violation of FTZ workers' rights as baseless

The BOI categorically refutes all allegations of violation of basic workers' rights in the Free Trade Zones, stated in a recent news release issued by the International Confederation of Free Trade Unions (ICFTU,) as unfounded, and draws the attention of the ICFTU to the Reports of the Committee of Experts on the Application of Conventions and Recommendations and to the Findings and Report of the European Commission on the application of Core Labour Standards in Sri Lanka, as the law and practice in Sri Lanka, including in the Free Trade Zones are in compliance with the Core Labour standards.

Contrary to what is reported by the ICFTU, an increasing number of trade unions have been accorded recognition by BOI enterprises within and outside the Free Trade Zones, after EU Special Incentive Benefits were granted to Sri Lanka. This renders the ICFTU allegation that "companies attempt to avoid collective bargaining and union recognition at their workplaces" as baseless.

As regards the alleged involvement of BOI in labour disputes, the Freedom of Association Committee of the ILO Governing Body (which examined the same allegation made by the International Garment Textile and Leather Workers Federation, on behalf of the Ceylon Mercantile and General Workers union) has confirmed the competence of the Commissioner General of Labour with regard to industrial disputes in Free Trade Zones, and noted that the BOI is not involved in dispute settlement, but only undertakes promotional and advisory services on labour management consultation and co-operation and labour related matters.
