Appeal filed by SLMC Athaulla group: 

Further hearing put-off

The Court of Appeal on Thursday put off further hearing of the appeal filed by the dissident faction of the SLMC Athaulla group seeking an order to vacate the earlier interim injunction by the District Court, for February 17.

The restraining order prevented S. Subairdeen, A.M. Athaullah, Dr A.L.M Hafrath, A. Uthumalebbe and A.J. Muzammil claiming and acting as Leader, Chairman, General Secretary, Senior Deputy Leader and National Organiser of the SLMC.

In this application, Athaullah and 11 others have cited SLMC leader Rauff Hakeem and 20 others as respondents.

The counsel for the petitioners Wijedasa Rajapakse PC submitted that the matter be settled before calling for the nomination for the forthcoming general election.

However, the Court held that this is an ordinary application. The Counsel submitted that the verdict given by the District Court was in favour of the defendant Hakeem and there was no such letter or a fax as claimed to be sent by defendant Hakeem and it was only a news created by the media.

Having heard the submissions, the Court put off further hearing for February 17.

Wijedasa Rajapakse PC, Kapila Liyanagamage, Abdul Kalam and Ananda de Silva appeared for the petitioners while Ikram Mohamed PC , Nizam Kariyyappar with A.M. Fizia appeared for Hakeem.
