by Sarath Malalasekera The Police Commission headed by President's Counsel Ranjit Abeysuriya yesterday approved the request made by IGP Indra de Silva to send ASP Kulasiri Udugampola on compulsory leave until the completion of the ongoing investigation into the Athurugiriya Millennium City Army safe house raid. Retired Justice D. Jayawickeram who conducted the inquiry into the safe house raid, handed over the findings to President Chandrika Bandaranike Kumaratunga. Later the report was forwarded to the IGP for necessary action. The Supreme Court has given a comprehensive order in connection with the safe house fiasco. Therefore the Police Commission could act on his request to send ASP Udugampola on compulsory leave, as there is a tendency that the ASP would interfere with the witnesses, the IGP said. The IGP empahised that if ASP Udugampola was found guilty, he would be charged under the normal law of the land, he would be interdicted and action would be taken according to the law. The IGP earlier declared that the Army and police personnel found guilty by the Presidential Commission in the Athurugiriya millennium city Army safe house raid would be prosecuted. The IGP said he would be consulting the Attorney General before instituting legal proceedings against the offenders. He said a special police team headed by a Senior Police Officer, had been assigned to commence investigations based on the report released by the Presidential Secretariat. A comprehensive report on the police investigation will be submitted to the Attorney General for his advise before legal action is preferred against those responsible. The Supreme Court recently held that the respondent ASP Kulasiri Udugampola had illegally arrested, detained and subjected the victims to inhuman and degrading treatment and treated them differently. The Supreme Court ordered ASP Kulasiri Udugampola personally to pay Rs.250,000 to the five petitioners who filed fundamental rights application for compensation. Any person found guilty following the investigations would be prosecuted under the existing laws, the IGP added. |
