Udatalawinna Trial-at-Bar : 
We went to Bogambara to obtain fingerprints of some accused - IP Ratnayake

CID IP Jagath Bandara Ratnayake said that they went to the Bogambara prison to obtain the finger prints of some of the accused in the current case and that the written permission granted by the Teldeniya Magistrate, bore the names of those whose finger prints were to be taken.

He was testifying before the Trial-at-Bar hearing the Udatalawinna massacre, on Thursday. He made this observation under cross examination by Defence Counsel Anil Silva.

The Trial-at-Bar comprise High Court Judges Eric Basnayake (President), Deepali Wijesundara and Sunil Rajapakse.

The witness further said that the letter was with his senior Nandasena. They took the finger prints for nearly 90 minutes. Later they saw the suspects at the Teldeniya Magistrate Court. But he could not remember whether he took finger prints of accused No. 4, 5, 6, 7, 8 or 9.Further witness said that he could not remember the "ogle" in the eyes of the 4th accused and scar on the face of the 5th accused and he did not note them.

Sometimes Nandasena might have noted them.

Defence Counsel:- "I suggest that Nandasena and you were the persons used by Linton Ratnayake to tell the witnesses the features of the suspects."

Witness:- "I did not tell the witnesses the details of the suspects."

The CID PC rejected the suggestion by the Defence Counsel that he noted down the features of the suspects in a separate paper and handed it over to Linton.

Defence Counsel:- "I suggest that CID had held a fraudulent identification parade misleading the Magistrate."

Witness:- "No."

Witness further stated that he did not use a Lady's hand bag with a camera to take photographs of the suspects in prison if necessary there were trained photographers for that purpose.

Defence Counsel:- "Can you remember that there was a complaint at the court that one Abeyratne attempted to take photographs of suspects in prison?"

Witness:- "There is no one called Abeyratne in the CID."

High Court Judge Eric Basnayake:- "Do you know that ASP Udugampola conducted a separate investigation in connection with this incident?"

Witness:- "Yes."

Witness said that if necessary pictures of suspects can be prepared in accordance with the features of them, with the help of computers. He did not know whether others prepared pictures of the suspects.

The witness rejected the suggestion by the Defence Counsel that he went to prison to collect the features of the suspects and thereafter prepared pictures of them with the help of computers and showed them to the witnesses.
