Defects in my new Puegeot caused me ridicule, says Susanthika by Indeewara Thilakarathne Colombo Additional District Judge Ranil Dharmasekara yesterday issued notice on the respondents in the damage suit filed by Sprint Queen Susanthika Jayasinghe against Car Mart Limited, a leading car sale mart in Colombo, claiming Rs. 2,375 million as damages for the alleged defects in the car she had bought. The judge also ordered the defendant to be present in Court on March 26, 2004. In this case filed through her attorneys G. G. Arulpragasam, Jayasinghe cited Car Mart Limited as the sole defendant. Jayasinghe states that she bought the car, a Puegeot 206, on September 5, 2002 for Rs. 2,375,000 and was registered with the Registrar of the Motor Vehicles. She claims that in spite of the one year gurantee and assurance of the condition of the car by the defendent, the car had many defects and was not, therefore, suitable for the purpose for which it was bought and that she had to take it, on several instance, to the defendent's workshop for repairs. She states that the car's convertible hood could not be opened and closed and the car could not be used at all on rainy days. Jayasinghe alleged that Car Mart had made false representations and the defects were due to the manufacturer's faults. The car is not suitable under Sri Lankan conditions, she said. Jayasinghe said she was subjected to ridicule, humiliation and embarrassment at public functions on numerous occasions. She claims Rs. 2,375,000 she paid for the car together with a further Rs. 5 million as damages. The Court issued the defendant to be present in Court on March 26, 2004. |
