CID asked to report facts to Magistrate by Sarath Malalasekera The Supreme Court yesterday directed Senior State Counsel Shavindra Fernando to direct the CID to report facts before an appropriate Magistrate in connection with investigations into allegations against Sri Lanka Telecom and Sri Lanka Cricket Chairman Thilanga Sumathipala today, December 4. The Bench comprised Chief Justice Sarath N. Silva PC, Justice P. Eddusuriya and Justice Nihal Jayasinghe. At the outset President's Counsel Rienzie Arsecularatne, Sumathipala's Senior Counsel sought Supreme Court order to prevent the CID from arresting his client until the final determination of the Fundamental Rights application before Court. The petitioner cited CID Director Senior SP Sisira Mendis, CID Senior SP D.Y.S. Samaratunga, the IGP, the Solicitor General and the Attorney General as respondents. Aresecularatne said the Attorney General had directed the CID on November 27 to produce his client before court on an allegation that he had aided and abetted Dhammika Amerasinghe to travel to London on a forged passport. He submitted that his client had not committed any offence and the police had forwarded wrong facts before the Attorney General and obtained an order. There was no adequate evidence against his client to arrest or to produce him before any court of law, Arsecularatne said. Chief Justice: Where is the principal suspect. Senior State Counsel: Your Lordship he is in remand custody. Answering the Chief Justice, the Senior State Counsel said according to law, he will report facts to court and further steps will be taken later. After examining the facts forwarded to the Attorney General, he directed the CID to report facts to court as there is a prima facie case against Sumathipala, the Senior State Counsel said. |
