AGA testifies before Udatalawinna Trial-at-Bar

Referring the notes it was impossible to say which characteristic features of the spent bullet cases released from weapons P-20 and P-21 were non-characteristic but the characteristic features of them were similar to the model spent bullet cases said, the Assistant Government Analyst P. G. Madawala testifying before the Trial-at-Bar hearing the Udatalawinna massacre while he was being cross examined by the Defence Counsel, Anil Silva in the High Court, Colombo, yesterday.

The Trial-at-Bar comprised High Court Judges Eric Basnayake (President), Deepali Wijesundara and Sunil Rajapakse.

Defence Counsel:- "Do you mean that the non-characteristic features of them also became similar later."

Witness:- "Non-characteristic meant that the certain characteristic feature tallied about 80%. It does not mean that it is not similar."

When the Defence Counsel suggested that the statement made by the witness was false, the Assistant Government Analyst denied it.

Defence Counsel:- "I suggest that you did not participate in the inspection but they were done by Silvan Rajapakse."

Witness:- "I reject it."

Defence Counsel:- "You had come to conclusions even before the inspection and according to that you prepared the notes."

Witness:- "It is not true."

At this stage Defence Counsel suggested that the witness had prepared the report according to the will of some officers of the CID and the witness rejected the idea.

When the Defence Counsel suggested that the evidence given by the witness were false, the Assistant Government Analyst denied it as well.

Then the Additional Solicitor General Palitha Fernando started to re-examine and the Assistant Government Analyst submitted that sometimes while the inspection was in progress the notes were made by Silvan Rajapakse under the instructions of the witness and Deputy Government Analyst. If they needed they could have changed them clearly on new papers. But they produced the real notes before the Court.
