16-year-old's assault case : 

Mother files rights violation application

The mother of a 16-year-old boy of Ratgama who was allegedly assaulted, tortured and sexually abused by Ratgama Police officers, filed a Fundamental Rights violation application in the Supreme Court yesterday.

Petitioner B.A. Karunawathie of Temple Road, Boosse filed the application on behalf of her son H.L. Sadun Kumara who was allegedly assaulted, tortured and sexually abused by five police officers attached to Ratgama Police.

The petitioner cited IP R. Chandimal de Silva OIC, SI J.T. Ramyasiri (OIC Crimes), Sergeant Silva, PC Chandrasiri Silva and PC Upul of Ratgama Police, Bandula Silva and Sanath Silva of Boosse, the IGP, Chairman of the National Police Commission and the Attorney General as respondents.

The petitioner stated that her son was compelled to leave Gintota Sri Medankara Maha Vidyalaya where he studied upto year nine, after his father's death on February 21, 2001.

The petitioner, the sole bread winner of the family was forced to work as a housemaid in Colombo 7 for survival.

Her nine-year-old daughter living with her, was schooling in Colombo. The petitioner alleged the 6 and 7 respondents had taken Sadun to Ratgama Police on September 13 and arrested, assaulted tortured and sexually abused him for several days without producing him before the Magistrate's Court.

The mother alleged that the police officers had applied chilly powder on his private parts when he cried not do so.

He was transferred to Kithulanpitiya remand prison on September 20 and was later admitted to Karapitiya Hospital in a serious condition.

The petitioner sought a court order directing the IGP and the National Police Commission to ascertain the identity of the police officers personally involved in the torture and also direct them to transfer the 1-5 respondent Police officers out of Ratgama Police to facilitate a fair inquiry.
