A/L students allowed to apply for National Education Colleges in 2005

Students who sat for the GCE Advanced Level Examination in 2003 would be able to apply for admission to National Colleges of Education for the year 2005, State Counsel Viveka Siriwardane de Silva submitted before the Supreme Court in a Fundamental Rights application filed by a student.

Petitioner Dulani Lasitha Gamage of Galle sat for the G.C.E. Advanced Level examination in April, 2003, filed the petition against a Gazette notification dated August 1, that had deprived her from applying for the admission to a National College of Education.

The Bench comprised Chief Justice Sarath N. Silva PC, and Justices Ameer Ismail and T.B. Weerasuriya.

Petitioner Dulani Lasitha Gamage of Galle cited the Chairman Colleges of Education Board, the Board of the Colleges of Education and the Attorney General as respondents.

The state counsel submitted that in terms of the instruction given by the first respondent, the Chairman Colleges of Education Board V.K. Nanayakkara, the petitioner and the other qualified students at the said examination in year 2003 would be eligible to apply for the admission of the Colleges of Education for 2005.

The gazette notification calling for applications for admission for 2005 would be published next year enabling the said students to apply.

The court observed that the petitioner would seek legal remedy in case they would be deprived of from applying for the year 2005.

Petitioner stated that she sat for the GCE A/L exam in August 2000. Later, she had unsuccessfully applied for admission for the said colleges for 2003, under the earlier procedure. For securing higher qualifications to enter a said College of Education in the year 2004, she had sat for the Advanced Level examination in April 2003.

She alleged that she had been prevented from doing so in terms of a gazette notice dated August 1, which had changed the previous criteria for admission to the educational colleges.

In terms of the said gazette notice, only the candidates who had sat for the A/L examination in the years 2001 and 2002 would be eligible to apply for the admission to said colleges for the year 2004.

Petitioner stated she could not even apply for admission for 2005, since the said gazette notification only permitted applications for 2005, for those who would sit for the A/L examination in 2004, however, under the previous criteria she would be eligible to apply for the year 2005.

Petitioner stated that the said change of criteria was arbitrary and in violation of her fundamental rights.
