Counsel for petitioners moves to file amended petition

Counsel for petitioners moved to file amended petition indicating that petitioners' intention in future to make application to enter United Kingdom, when the Fundamental Rights application challenging the finger printing the British Visa applicants was taken before the Supreme Court, Tuesday.

The Bench comprised Chief Justice Sarath N. Silva PC, and Justices H. S. Yapa and T. B. Weerasuriya.

Petitioners Chief Opposition Whip Managala Samaraweera MP and T. G. Ruwan Prasanna Ferdinandis cited the Foreign Minister, the Prime Minister and the Cabinet of Ministers, Acting Secretary to the President and the Attorney General as respondents.

Counsel Wijayadasa Rajapakse further submitted that the petitioner would file the amended petition and thereby would plead that imminent infringement to their fundamental rights due to the alleged procedure of finger printing the British Visa applicants.

Earlier, the counsel moved for time when the court pointed out that the petitioners could not claim infringement of their rights since neither they had applied for the British Visa nor had mentioned their intention to do so in the petition.

Additional Solicitor General Saleem Marsoof submitted that he would obtain instructions from the first respondent Foreign Minister on two matters i.e., whether he had approved to introduce the alleged system and whether he would ensure that the people who seek British Visa would not be discriminated.

Petitioners stated that the British High Commission had initiated the said project with effect from July 23 and was in violation of the Fundamental Rights of the people. They further alleged that the government had approved the said project in violation of the rights of the people.

They sought a court order directing the respondents to suspend the sanction given to initiate the said project.

Wijayadasa Rajapakse with Kapila Liyanagamage appeared for the petitioners. ASG Saleem Marsoof PC with state counsel Harsha Fernando appeared for the Attorney General. The case was to be listed for support on October 6.
