by Indeewara Thilakarathne The Court of Appeal directed the Sri Lanka Bureau of Foreign Employment (SLBFE) to accept and process the application for the renewal of the licence issued to "Acura" Foreign Employment Agency until the final determination of the plea made by Suraj D. Dandeniya (proprietor) on behalf of the agency. In this application the petitioner, the Proprietor of the "Acura" Employment Agency, Suraj D. Dandeniya has cited the Sri Lanka Bureau of Foreign Employment as the respondents. The plea was heard before Justice Udalagama. In the order it was observed that the counsel for the respondent had objected to the extension of the interim relief granted by the Court on June 20, 2003. It was further stated that the relief was granted with the intension of preserving the efficacy of the final relief that the Court might grant. The petitioner's purpose would be lost if the aggrieved party is thrown out before the final determination of the case. The order stated that the petitioner made out a prima facie case and that the application was maintainable.The Court held up the view that the operation of the impugned order would cause hardships and injustice to the petitioner. Therefore, the Court directed the respondent to accept and process the application made by the petitioner for the renewal of the licence issued to him. Further hearings were put off for September 12, 2003 for the respondents to file their objections. Kuwera de Soysa with S. Mahawanniarachchi instructed by G. G. Arul Pragasam appeared for the petitioner while Gomi Dayasiri with Asoka Weerasinghe and Salinda Jayasinghe appeared for the respondents. |
