by Indeewara Thilakarathne Five prosecution witnesses in the Bidunduwewa mass murder case who were earlier remanded for making false statements under oath, were yesterday indicted on charges of contempt of Court. The final order was fixed for August 28 and the accused were remanded till then. The five were R.M. Priyanthalal, D.V. Susantha Ravindralal, P.M. Gamini Wijesuriya and R.M. Nandasiri Rajapakse. The Trial-at-Bar comprised High Court Judges Srath Ambepitiya (President), Erick Basnayaka and Upali Abeyaratne. The Counsel for the accused submitted various personal reasons to mitigate the punishment and pleaded guilty to the charges on which they were indicted yesterday. The Counsel for the prosecution Priyantha Navana submitted that the offence of making false testimony under oath was very serious as the final verdict was based on those evidence. The State Counsel also pointed out that false evidences were made with the intention of not implicating villagers and relations in the case and that was an undue influence on the mechamism of administration of law. Citing the case of H.N. De Silva vs AG, the Counsel submitted that this kind of acts should be nipped in the bud. He said that it was his view that mere fine is not sufficent and urged court to impose at least a light imprisonment. He further stated that two years terms of RI or a fine of a sum of Rs. 500-1,000 be imposed on the accused in terms of section 449 (1) of Criminal Procedure Code. The order was fixed on August 28. |
