Order Nisi issued to hold inquries into Dr. Gamini Corea's declining health

The Additional District Judge Lalith Jayasuriya issued an Order Nisi for an inquiry to be held to determine the state of the declining health of the respondent Dr. Gamini Corea.

The order was a sequel to a petition made by Dr. Corea's power of attorney Deshamanya Lalith Kotalawala.

The petitioner states that he is a close relative of Dr. Gamini Corea and that he is the Chairman of the Ceylinco Group of Companies with 15 offices around the world and a workforce of about 20,000.

The petitioner states that the respondent is 77 years old and had worked as a Deputy Governor of the Central Bank. The respondent Dr. Gamini Corea is the Former Secretary General of UNCTAD and is a renowned international economist.

The respondent owns properties in Sri Lanka and has several millions of rupees in bank accounts.

Among other things the petitioner stated that around January 12, 2003 the respondent had sought the petitioner's help and complained that his servants did not provide him with his meals and the servants were often intoxicated with liquor.

The petitioner stated that the respondent's servants were drunk and that Dr. Corea was in a disturbed state. On examination the petitioner found out that the rooms of the respondent's residence had been rented out by his servants. Dr. Corea's health is in a deteriorating state.

Dr. H. Asita de Silva who did a medical check-up on the respondent had diagnosed that Dr. Corea is suffering from an alzheimer like condition and his mental activities and reproductive system have also been affected by this alzheimar condition.

The petitioner claimed that Dr. Shriyantha Mendis had confirmed this condition when he examined the respondent on July 3, 2003.

According to a last-will which the petitioner claimed was recovered from the documents belonging to the respondent, the respondent had named Mrs. Suganthi Kadirgamar as the power of attorney to set up the "Gamini Corea Foundation" by allocating a considerable portion of the property owned by the respondent including the properties in Switzerland. However respondent had not signed the said last-will.

The petitioner stated that the respondent's health is deteriorating and he was incapable of managing his own affairs and that the respondent is in greater danger of being cheated by an outside party or to exploit his mental weakness to achieve their ends.

Therefore the petitioner as a close relative and power of attorney of the respondent, urged the court to issue an order Nisi in terms of Section 558 of the Civil Procedure Code to determine whether the respondent is in a position to manage his own day-to-day affairs.

Accordingly the Court issued an order Nisi to hold an inquiry into the declining health of the respondent.

The petition was settled by G. G. Arulpragasam.
