Prof. Chandrasiri Nirielle files rights petition

Professor Chandrasiri Nirielle filed a rights petition before the Supreme Court against a letter of warning signed by the Vice Chancellor of the University of Ruhuna.

The Petitioner cited 20 respondents including the University, its Vice-Chancellor Ranjith Senarathne and the Members of the University Council.

The Petitioner claimed that he was a senior Forensic Lecturer at the University.

Petitioner stated that Paediatricians who were not attached to the Health Department but to the Universities, discharge the functions of the JMOs in child abuse cases. They did not fall within the definition of the Government Medical Officers under the Code of Criminal Procedure and they were not entitled to examine children for medico legal purposes, issue reports to the Police and to other institutions.

Petitioner stated that he wrote to the relevent authorities drawing their attention to the matter. He stated that a senior lecturer at the Paediatric Department complained to the Medical Council about the said letter sent by the petitioner on the allegations of professional misconduct. He stated that the allegations held against him by the Medical Council did not amount to professional misconduct.

He alleged that he received a warning letter signed by the Vice Chancellor in respect of the said letters and stated that it was in violation of his fundamental rights.

The petitioner claimed Rs. one million as compensation.
