CA issues notice on all respondents

The Court of Appeal yesterday ordered the issue of notices to all respondents returnable on March 31, when a writ application challenging the import of equipment and the issue of a broadcasting license to the LTTE peace secretariat came up before Justice K. Siriapavan.

The petitioners Dr. Piyasena Dissanayke Secretary, Sinhala Jatika Sangamaya and, Dias Bandaralage Ajith Shantha Kumara Jayathilaka have made separate applications for the grant and issue of mandates in the nature of writs of Certiorari Mandamus and Prohibition under Article 140 read with Article 126 (3) of the Constitution in connection with the import of radio transmitting equipment and issuing of a Broadcasting licence to the LTTE peace secretariat.

The two petitioners had cited the Director General of Customs as the first respondent and the Minister of Mass Communication, its Secretary and the Telecommunication Regulatory Commission of Sri Lanka as the 3rd, 4th and 5th respondents. They had also cited Secretary General LTTE Peace Secretariat as the 2nd and 6th respondents in the respective petitions. Meanwhile, the petitioner, the Sinhala Jatika Sangamaya, had named the Royal Norwegian Ambassador as the 2nd respondent.

Among other matters the petitioners had pleaded to direct the Director General of Customs to forfeit the equipment and to declare that the issue of Licence to operate and maintain a private Broadcasting station was unlawful.

Manohara de Silva with W. D. Weeraratne, G. W. C. Bandara and Nimal Hippola appeared for the petitioners.

Additional Solicitor General Saleem Marsoof PC and State Counsel Sumathi Dharmawardana appeared for the Director General of Customs and the Secretary, Ministry of Mass Meda while L. C. Seneviratne PC appeared for Minister of Mass Media.

Further hearings were put off for March 31.
