Passenger sues Emirates for loss of hand luggage

The Additional District Judge of Colombo Ranil Dharmasena yesterday ordered summons on Emirates when a petition filed was by a former Superintendent of Police, claiming US dollars 3,000 against the loss of his hand luggage during a flight from Dubai.

Petitioner F.N.D. Jilla (84) had submitted that on August 10, 2000 he boarded an Emirates flight at the Dubai airport and carried in his possession a bag as hand luggage.

As he proceeded through the air bridge leading to the entrance of the aircraft. The employees or agents of Emirates had inspected Jilla's hand luggage.

Despite his appeal that his bag contains valuables and that it had not been looked or labelled, the Emirates agents had insisted he leave the bag with then and that it would be safely returned when he gets off at Katunayaka.

On the same day at 10.30 p.m. when his aircraft landed at Katunayake, prior to disembarking from the flight Jilla had requested the said agent to return his bag. At this stage they had informed him to proceed to the relevant baggage turn-belt and collect it. The plaintiff being perturbed by the turn of events had made further appeals to the Emirates agents to return his hand luggage which contained US dollars 3,325 in cash and travellers' cheques and Sri Lanka Rs. 6,500 and Rs. 200,000 worth of certificates of deposit.

Thereafter the said agents had informed Jilla to make his complaints to their katunayake representatives.

He had waited for four hours at the baggage turn-belt and had later lodged complaints to the Emirates local representative and the Criminal Investigation Department about the incident.

He pleaded Court for an order and a decree to recover US dollars 3,000 or its equivalent in Sri Lankan rupees.
