Case against PA Parliamentarian fixed for April 25

Panadura Provincial High Court Judge A. Samith de Silva fixed the murder and unlawful assembly case against the Colombo District Peoples Alliance Parliamentarian Chandana Kathiriarachchi and four others for April 25, May 9, May 23, and July 13th respectively.

When the case was called before court on Wednesday, February 5 the accused G.U. Sunil Perera, D.M. Ruwan Chandana Fernando, M. Mahesh Peiris, K. Nihal Suresh and Devage Alias Chandana Kathriarachchi were present.

They were indicted with being involved in an unlawful assembly with the objective to commit the murder of Don Kathriarchchige Chandraratne and causing injuries to K. Don Karunaratne of Piliyandala on 24th August 1996, committing an offence punishable under Sections 32,146 and 296 of the Ceylon Criminal Code.

Jayaweera Bandara, Counsel for the accused told court that Presidents Counsel R.I. Obeysekera who is appearing for the Udatalawinna murder case was also retained to appear for the Chandana Kathriarachchi murder case and he wanted a long date. Wasantha Bandara, Senior State Council appearing for the Attorney General objected and told court the prosecution wishes to have the trial at a shortdate.

Summons were issued by the court on the prosecutions witness on the last date but no summons were served on them by the fiscal.

The Judge scrutinised the case record and found that the Court has ordered to issue summons but the officer had not taken action to issue summons and served on the prosecution witnesses.

The judge called for written explanation from the summons issuing officer of the Court.

After discussing the government convenient for the trial the judge asked a police inspector who was present in court whether he had received summons to attend court today to give evidence in this case. The inspector said he did not receive summons but the Piliyandala police conveyed a message to attend court in connection with this case.

The judge then fixed the case for trial and warned the accused to appear before court on the respective trial dates.
