Blue Diamonds case: Kotelawala withdraws revision application

Ceylinco Group Chairman Lalith Kotelawala, along with four other petitioners withdrew a revision application he had filed before the Court of Appeal yesterday and the Court thereby dismissed it.

The Bench comprised Justices Raja Fernando and G.W. Edirisuriya. The Petitioners had filed the instant application against the summons in the Fort Magistrate's Court being served on them in respect of a complaint filed by businessman Daya Senanayake.

The Petitioners had alleged that plaintiff Senanayake had wrongfully suppressed material facts in respect of an application filed by plaintiffs in the Magistrate Court.

Yesterday's move was another in a lengthy court battle between Kotelawala and Senanayake over the Blue Diamond Company affair. The tussle originated after Senanayake, who was acting for Kotelawala as Chairman of Seylan Bank when the latter was injured in the Central Bank Bomb blast in 1996, approved a loan facility to a company called Gold Lada with shares of Blue Diamond Worldwide placed as security. A stipulation was that the Blue Diamond shares would be sold if the loan was defaulted.

Kotelawala claims that Gold Lada did not pay the loan and therefore Seylan was compelled to sell the shares. While court cases in this matter were pending Senanayake made a private plaint in the magistrate's court against Kotelawala, the Seylan CEO and Deputy Chairman.

Kotelawala says the complaint made against him at the Magistrate's court was to harass and humiliate him. That is why he had filed a revision application before the Court of Appeal. But now he has decided to withdraw it and face the inquiry at the Magistrate's court level. He says he will go to Magistrate's court in the interest of the members of the public facing private plaints.
