by Wasantha Ramanayake The Supreme Court yesterday allowed to withdraw a Fundamental Rights petition filed by an authorised officer of the Bribery Commission against the Puttalam Magistrate. The court further directed the State Counsel Riyaz Hamza to inform the court before March 15, as to what action the police proposed to take with regard to the charges of Criminal Trespass and Contempt of Court filed against the petitioner. The Bench comprised Justices S. W. B. Wadugodapitiya, C. V. Wigneswaran and Asoka de Silva. Petitioner, H. M. Herath, an Authorised Officer of the Commission to Investigate the Allegation of Bribery or Corruption has cited Puttalam Magistrate, IP W. A. Ranjith, HQI Puttalam, Inspector General of Police and Attorney General as the respondents. Petitioner's Counsel K. Thiranagama submitted that the petitioner visited the Puttalam Magistrate's Court for an official purpose with a letter under the hand of the Director Investigation of the Bribery Commission, to obtain a statement and certified copies of proceedings of a certain case where the petitioner was summoned and was meted out to a degrading treatment as a common criminal by the Puttalam Magistrate. He further submitted that the Police charged the petitioner with Criminal Trespass and Contempt of Court by alleging that the petitioner entered the chamber of the Magistrate without his prior permission. The case was put off for March 15. |
